Warranty Terms
These warranty terms apply to devices belonging to the CoolSens family: the CloudHub and the Node sensor.
Guarantor
The warranty provider is INVENTIA Sp. z o.o. with its registered office in Warsaw, at ul. Poleczki 23, 02-822 Warsaw, entered in the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, XX Commercial Division of the National Court Register under the number KRS 0000023113, NIP 9512017534, REGON 017311391.
Subject of warranty
- The Guarantor assures the high quality of its products and guarantees the Buyer proper, i.e., in accordance with the attached manual or other specifications, operation of the Product.
- Under the conditions described in these Warranty Terms for CoolSens modules, the Guarantor provides the Buyer with a warranty for the operation of the Product.
- The warranty period provided is:
- 24 months for Products manufactured by Inventia,
- 12 months for Products manufactured by third parties and distributed by the Guarantor,
- 12 months for batteries and accumulators, calculated from the date of sale, confirmed by a VAT invoice. Individual contractual provisions take precedence over the above conditions.
- The warranty is directed to the Buyer of the Product from the territory of the Republic of Poland.
- During the warranty period, the Guarantor undertakes to repair, free of charge, any defects disclosed during the warranty period.
- Under the warranty, the Buyer has the right to warranty repair of the Product. Warranty repair means specialized activities involving the repair or replacement of a defective component, excluding activities described in the manual that belong to the normal operational maintenance by the Buyer.
- Under this warranty, the Buyer has the right to exchange the product for a defect-free one only if the Guarantor’s Warranty Service determines in writing that it is impossible to remove the defect. If the complaint is accepted and the Product is exchanged for a defect-free one, the Buyer is obliged to return the claimed Product in complete condition. Otherwise, the Guarantor will charge the Buyer the equivalent value of the missing or damaged components due to reasons attributable to the Buyer, as well as the costs of their replacement.
Reporting a Defect and Repair Time
- The Guarantor undertakes to fulfill the obligations arising from these warranty terms within 30 days from the date the item is delivered by the Buyer or collected from the Buyer.
- If the repair or replacement of the Product within 30 days proves impossible, the Guarantor will inform the Buyer with justification and specify the necessary time to rectify the defect of the Product.
- The Guarantor will make every effort to repair the reported defects of the Product promptly upon delivery to the Service Point, considering the above points.
- The warranty period is extended by the repair time, unless the repair is carried out on the day of the report. The defect of the Product can be reported:
- to the Seller;
- directly to the Guarantor’s Service Point at serwis@inventia.pl;
- The report should be made immediately after discovering the defect, but no later than 7 days from the date of its discovery. The Buyer is obliged to attach a warranty protocol (available at the provided link), indicating the defect, its description, circumstances of occurrence, type of Product, its serial number, invoice number, purchase date, contact person’s details with phone number and email address, and the shipping address of the Product. Failure to meet this requirement may extend the repair time beyond the period specified in point 2.
- Using the defective Product results in the loss of the Warranty.
- The Product subject to the Warranty must be properly secured and delivered in a complete condition for repair to the address provided to the Buyer by the Guarantor or the Seller after receiving the report, ensuring safe transport. Upon receiving the warranty report, the Guarantor will organize (in consultation with the Buyer) the transport of the Product.
- If, during the fulfillment of warranty obligations by the Guarantor, it turns out that the reported Product has damage not covered by the warranty and requires repair, the Guarantor will inform the Buyer and present an offer for the repair. Performing activities under this paragraph is not the exercise of warranty rights.
- In case of rejection or lack of acceptance of the repair offer within 30 days, the Buyer will be charged a diagnostic fee and logistics service cost of 160 PLN net, and the unrepaired Product will be returned or the Buyer can commission the Guarantor to dispose of it.
- For services performed under point 8, the Guarantor will issue a VAT invoice to the Buyer each time.
- After delivering the Product to the Guarantor’s Service Point, the Guarantor will:
- create an individual service report number for each device, confirming receipt of the device,
- review the report and inform the Buyer about the repair status,
- within the service report containing the description of the fault and a list of additional equipment, describe the performed activities, list replaced components, and evaluate its condition after the repair.
Warranty Coverage
- The Guarantor is responsible for defects arising solely from causes inherent in the sold Product before its delivery. However, the warranty does not cover damages occurring after its sale due to other causes, particularly:
- as a result of improper (non-compliant with the user manual) use, installation, reconfiguration, use of embedded software versions other than those currently recommended by the Guarantor, storage, maintenance, or transport;
- caused by random events of force majeure, such as fire, flood, lightning strike, incorrect power supply voltage, or other natural disasters or unpredictable accidents, as well as damage not caused by the Guarantor, including chemical and mechanical damage;
- due to damage resulting from improper or non-compliant assembly, installation, or maintenance, and as a result of normal wear and tear of the Product;
- in case of unauthorized (by the Buyer or other unauthorized persons) repairs, modifications, and structural changes to the Product;
- damage resulting from improper operation of third-party software installed without the Guarantor’s consent in the purchased Product.
- The Guarantor is not responsible for the loss, damage, or destruction of the Product resulting from causes other than defects inherent in the Product. In particular, the rights under the warranty do not include the right to claim reimbursement of incurred costs and lost profits as a consequence of the Product’s failure.
- The warranty does not cover any damages related to the need for disassembly, delivery, installation, or temporary deprivation of the ability to use the Product.
- Warranty Service activities do not include:
- performing control tests of products, conducted at the Buyer’s request, resulting in the determination that there is no need for warranty repair, and those activities that, according to the user manual, are the responsibility of the Buyer, e.g., installation, configuration of essential user parameters, embedded software updates.
- Products with missing or altered serial numbers (if present) or with damaged seals.
- The Buyer is obliged to carry out all repairs and servicing of the Product exclusively through the Guarantor’s Warranty Service, Seller, or authorized service personnel.
Loss of Warranty Rights
- The Buyer loses warranty rights if any repair, incorrect installation, or modification of the Product is carried out by the Buyer themselves or by a third party other than the Guarantor, Seller, or authorized service personnel. This also applies if any of the security seals are found to be tampered with, damaged, or broken, or if they are covered in a way that prevents their identification, or if serial numbers or other identifying marks on the Product are found to be damaged, tampered with, or removed.
- To avoid any doubts, the warranty does not cover defects resulting from the actions of third parties, especially unauthorized repairers or specialists whom the Buyer has commissioned to install, configure, or repair the Product.
- The use of consumables not compliant with the Guarantor’s instructions or the application (connection) of elements not compliant with the Guarantor’s instructions by the Buyer results in the loss of the warranty on the Product damaged as a result of this action. Any repair arising from such actions, if commissioned by the Buyer, is not covered by the warranty.
Additional Warranty Conditions
- The Guarantor performs its warranty obligations on business days, i.e., from Monday to Friday, excluding public holidays that fall within this period.
- The Guarantor’s liability under the warranty is excluded.
- For matters not regulated by these warranty conditions, the relevant provisions of generally applicable law shall apply.
